1. Rental & Equipment
This Agreement is between HB Beach Club ("Company") and the renter named above ("Renter") for the beach equipment, bike, or setup package selected above (the "Equipment"), delivered to and/or picked up within Huntington Beach, CA for the rental date specified. As part of this Agreement, Renter has provided a photo of a valid driver's license or state ID, which Company keeps on file solely for identity verification and to help resolve any damage, loss, or dispute related to the rental.
2. Renter Responsibilities
- Renter will use the Equipment only as intended and take reasonable care of it while in Renter's possession.
- Equipment must be available for Company pickup at the agreed time and location, in the same condition as delivered, normal wear excepted.
- Renter is responsible for the Equipment from time of delivery/pickup until Company retrieves it or Renter returns it.
3. Damage, Loss & Deposit
A refundable security deposit is authorized on Renter's card as shown below. If Equipment is returned undamaged and complete, the deposit hold is released (typically within 1–5 business days, per your bank). If Equipment is damaged, lost, or not returned, Company may charge the deposit — up to the full authorized amount — toward repair or replacement cost. Charges beyond the deposit amount will only be made with Renter's separate authorization or as otherwise permitted by law.
4. Assumption of Risk & Release
Renter understands that beach, ocean, sun, sand, cycling, and related outdoor recreational activities carry inherent risks, including but not limited to injury, drowning, heat exposure, and property loss. Renter voluntarily assumes these risks. To the fullest extent permitted by California law, Renter releases HB Beach Club, its owners, and its staff from liability for injury, loss, or damage arising from use of the Equipment or participation in related activities, except to the extent caused by Company's gross negligence or willful misconduct.
5. Cancellation
Cancellations made with reasonable advance notice are not charged. Same-day cancellations or no-shows may result in a charge against the deposit to cover dispatch and preparation costs, at Company's discretion.
6. Governing Law
This Agreement is governed by the laws of the State of California. Any dispute will be resolved in Orange County, California.
7. Electronic Signature
By signing below, Renter agrees this electronic signature is legally binding and equivalent to a handwritten signature, and confirms all information provided is accurate.
